    USE AND PRIVACY POLICY

    This Web page contains the terms and conditions concerning your use of this Web Site (www.mainecaucus.net). By accessing this Web Site, you agree to be bound by the following terms and conditions:

    0. Data. All data for mainecaucus.net is kept at MaineStreet Communications (maine.com), the internet service provider. At this writing, MaineStreet has not been served any National Security Letters and is not under surveillance on our premises; we cannot speak for our upstream providers - some of whom certainly ARE under continual surveillance. Users should assume their traffic is monitored.

    1. COPYRIGHTS. All web site design, text, graphics and the selection and arrangement thereof are the copyrighted works of maine caucus.

    2. TRADEMARK INFORMATION. The products and services identified in this web site are trademarks or service marks of their respective owners.

    3. SITE USE AND CONTENT. You may view, copy or print pages from this web site knowing that at any time, we may, without further notice, make changes to this web site, to this Use and Privacy Policy and/or to the products or services described in this Use and Privacy Policy.

    4. MEMBER ACCOUNT, PASSWORD AND SECURITY. For certain types of features available through this web site, we require the use of encryption technologies provided for your protection and/or your use of a UserID and password after setting up a User Account.     5. SECURITY AND PRIVACY. We respect and are committed to protecting your privacy and the privacy of our membership as a whole. We will ensure that your personal information is only used in ways that are in compliance with this Section.

      (a) Use of Information. Information collected by Maine Caucus is used for three main purposes. First, we collect information to improve this web site. Second, we collect information to personalize the experience of the users of this web site. Finally, we collect information to enable our members to conduct transactions [discussions, forums and other per user activities] on this web site.

      (b) How Information is Collected.

        (1) IP Address. Across systems over a limited period of time, IP addresses can be traced to individual users. We cannot do that ourselves.

        (2) Cookies. Maine Caucus will set a cookie for all registered users. A cookie is a small piece of data that is sent to your Internet browser from a Web server and stored on your computer's hard drive. A cookie, by itself, cannot read data from your hard disk or read cookie files created by other web sites. A cookie, by itself, does not damage your system. We use cookies to identify and keep track of user sessions in order to personalize the content you see while working on the site. If you choose not to accept these cookies, you will not be able to use some of the features on the Maine Caucus web site.

      (c) Protection of Collected Information. When you place orders or access your User Account information, you will be in a secure server environment. The secure server software (SSL) encrypts all information you input before it is sent to us. Furthermore, all of the customer data we collect is reasonably protected against unauthorized access. There is no protection from abuse of authority or someone rummaging in the dumpster.

      (d) Disclosure of Collected Information. Maine Caucus will not disclose information without legal and due process; we will disclose information when compelled to:

      • comply with a legal and due process served on Maine Caucus;
      • protect and defend the rights or property of Maine Caucus or a user of Maine Caucus web site;

      (e) Parental Consent for Children's Information. Maine Caucus will not knowingly collect personally identifiable information about a child. Children under the age of thirteen (13) may read the Maine Caucus web site, but they may not register or participate in any interactive features.

      IN NO EVENT MAY A CHILD UNDER THE AGE OF THIRTEEN (13) CREATE OR SET-UP A MAINE CAUCUS USER ACCOUNT IN HIS OR HER OWN NAME.

    (f) Privacy Outside the Maine Caucus web site. The Maine Caucus web site may contain many links to other web sites. Maine Caucus is not and cannot be responsible for the privacy practices or the content of any of those web sites and advertisements of third parties.

    (g) Updating and Changing Personal Information. You may update or change information related to your Maine Caucus account with your User Account and password.

Neither Maine Caucus nor any of its affiliates, nor the directors, officers, employees or other representatives of any of them, will be liable for any damages arising out of or in connection with the use or purchase of any products or services discussed, identified and/or purchased on this web site, or for information obtained in response to questions asked through this web site. This is a comprehensive limitation of liability that applies to all damages of any kind, including compensatory, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

      (d) Shipping and Billing to US Addresses Only; Product Availability. Maine Caucus does not process orders to foreign shipping or billing addresses. Maine Caucus tries to give product availability information on this web site, but sometimes products are unexpectedly unavailable. In addition, Maine Caucus updates and improves its products and services on a continuous basis. Maine Caucus will inform you if any Maine Caucus products that you ordered turn out to be unavailable. Maine Caucus may use e-mail to inform you.

      (e) E-mail Receipt. After you place an order with Maine Caucus, you should receive an e-mail acknowledgement within one business day to confirm that Maine Caucus has accepted your order and is processing it, provided that you have supplied Maine Caucus with a deliverable e-mail address. The e-mail shall contain the details of your order, the itemized and total amounts that will be billed to your credit card or customer billing account ("Customer Billing Account"), including all applicable taxes and charges. A receipt will also be included with your purchase. Be sure to keep your receipt. You will need it if you require any warranty service.

      (f) Charging Your Credit Card or Customer Billing Account. Maine Caucus will not charge your credit card or Customer Billing Account until it ships your order and performs a credit check, if applicable. If a product cannot be shipped within three (3) business days of Maine Caucus's receipt of your order, Maine Caucus will notify you by e-mail. If your credit card is rejected when Maine Caucus charges it, or your Customer Billing Account is not in good standing, Maine Caucus is not obligated to ship any products or provide any services. Maine Caucus will contact you by e-mail, telephone or any other reasonable means to advise you of such a situation.

      (g) Prices, Taxes and Shipping & Handling. All prices are stated and payable in US dollars. The prices for products and services quoted on this web site do not include taxes or shipping and handling, if applicable. Maine Caucus charges all applicable taxes on products and services.

      (h) Product Availability. Product availability may be limited. Although availability may be indicated on the web site, we cannot guarantee product availability and products nonetheless may not be available for immediate delivery. We reserve the right, without liability or prior notice, to revise, discontinue or cease to make available any or all products or to cancel any order. If there is any revision or cessation, we may, in our discretion, ship products which have substantially similar functionality and specifications to the products ordered.

      (i) Return Policy. Maine Caucus will accept returns of all products within 30 days of the invoice date with the exception of opened software packages or film. All returns must be pre-approved by Maine Caucus and a Return Merchandise Authorization number ("RMA") must accompany all returns. An RMA, if approved, may be obtained by contacting Maine Caucus by phone or by sending an email to returns@mainecaucus.net -. Applicable shipping and handling charges will not be refunded unless Maine Caucus is responsible for the shipment of a wrong product. Note that this return policy, including the number of days allowed for a return, may be changed without notice and this policy may not apply to certain products. A copy of the receipt or shipping invoice that was enclosed with the product must accompany the return. Upon Maine Caucus's receipt of the returned product, Maine Caucus shall credit your credit card account number or Customer Billing Account used for the original purchase. Maine Caucus cannot exchange products through the web site; rather, the user must return the product (in the manner described above) for a refund within the appropriate time period and purchase a new product over the web site.

    8. NON-TRANSFERABILITY OF USER ACCOUNT. In order to take advantage of certain enhanced portions of this web site, a user of this web site must individually register and create a UserID. Any user of this web site must agree and acknowledge that the User Account and UserID are non-transferable, and that such user is obligated to take preventative measures to prohibit unauthorized users from accessing this web site with his or her UserID and password. In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, we shall have the right to refuse or cancel any orders placed for products listed at the incorrect price. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card has been charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account in the amount of the charge.
